Is mediation right for you?

When you begin to contemplate divorce, a wide array of scenarios will likely play out in your mind. Will you and your spouse have one of those bitter, drawn out divorces or will you be able to discuss issues, find ways to compromise and resolve disputes?

If you fall into the second category, you might find that the mediation process available to Ohio couples is right for you. It's a process in which a neutral mediator sits down with you and your spouse to hold discussions to resolve disagreements over important divorce issues including child custody, visitation, spousal support and property division, among others.

Perhaps the first thing to understand about mediation is that the mediator won't be deciding who is right or wrong or who should have custody or get the house. Instead, you and your spouse decide the terms of your divorce so that you are in control rather a court and a judge.

The mediator guides the discussions so that both parties can focus on finding resolutions rather than rehashing arguments or pointing fingers. The mediator might also ask that both parties agree to basic ground rules, including things such as no name-calling, only one person speaks at a time, and so on. These guided, civil discussions are aimed at finding terms you can agree on, write down and present to a court.

Some of the benefits of mediation are obvious: you are and your spouse are in complete control of the terms of your divorce, allowing you to create a custom agreement that works in your unique situation. A less obvious benefit is that the mediation process is typically less expensive than a litigated divorce.
