Can you divorce without going to trial?

Divorce is still a common part of life for many married couples in Ohio. Cambridge has the highest divorce rate in the state, with 1,954 divorcees residing in the city. 

Divorcing a spouse is incredibly stressful. This holds especially true when you consider that many couples end up spending months in a courtroom hashing out the finer details of the separation. However, couples in Ohio have the option of avoiding a drawn-out trial as long as they can reach agreements independently. 

Resolve issues on your own

In the event that you and your spouse are still on reasonably good terms, then you should consider meeting in mediation to determine how to divide assets. Although you can avoid going in front of a judge, you will still need attorneys to help you both understand what is fair. You need to sit down to discuss proper division, child custody and alimony. Naturally, couples without children or any substantial assets will have an easier time coming to a consensus. 

Meet with a mediator

You and your spouse deserve to meet with an objective third party in case you butt heads on any issues. You should meet with a mediator who will allow you to talk about your issues in a relaxing environment. Attorneys do not have to be present during these meetings. If you worry about the cost of a mediator, then talk to your spouse about splitting the price. 

See an arbitrator

Arbitration is another path that couples can pursue. Instead of meeting with a mediator, the couple allows an arbitrator to look at the issues and reach a decision on his or her own. Arbitration has numerous benefits over a trial. However, you need to be careful in pursuing this path because an arbitrator's decision is final. Talk with your attorney to determine which option is ideal for you.
